Les associations féministes estiment que le délai de trois ans est trop court, sachant que de nombreux cas de viols sont requalifiés en ces termes pour des raisons multiples.

L'affaire Banon a donné un nouvel écho à l'une des revendications des associations féministes : l'allongement de la durée de prescription des agressions sexuelles. Entrant dans la catégorie des «délits», les agressions sexuelles ne sont poursuivables que pendant trois ans, alors que le viol, qui est un crime, peut donner lieu à un dépôt de plainte jusqu'à dix ans après les faits.

ANTĐ - Các công tố viên Pháp ngày 23-9 cho biết sẽ tổ chức cuộc đối chất trực tiếp giữa cựu Tổng giám đốc Quỹ Tiền tệ quốc tế (IMF) Dominique Strauss-Kahn và nữ nhà văn Pháp, Tristane Banon.
Trước đó, nữ nhà văn 32 tuổi này đã cáo buộc ông Strauss-Kahn âm mưu cưỡng hiếp cô trong cuộc phỏng vấn tại một căn hộ ở Thủ đô Paris (Pháp) vào năm 2003, tuy nhiên, ông Strauss-Kahn đã phủ nhận cáo buộc trên. Hiện chưa rõ khi nào cuộc đối chất sẽ diễn ra.

Vị cựu Tổng giám đốc IMF đã trở về Pháp vào tháng này và đưa ra lời xin lỗi trong một cuộc phỏng vấn mới đây trên truyền hình về “sai lầm đạo đức” khi quan hệ với một nữ nhân viên hầu phòng ở New York (Mỹ). Trong cuộc phỏng vấn hôm 18-9, ông Strauss-Kahn cho biết ông đã đánh mất mọi thứ do vụ bê bối tình dục ở New York. Dù vậy, những nỗ lực trở lại chính trường Pháp của chính trị gia 62 tuổi này lại bị cản trở do những cáo buộc từ Tristane Banon.

Theo nguồn tin cảnh sát Pháp, ông Strauss-Kahn thừa nhận đã cố hôn cô Bannon nhưng phủ nhận tấn công tình dục. Ông Strauss-Kahn gọi những cáo buộc của cô Bannon là tưởng tượng và vu khống. Các cuộc thăm dò dư luận cho thấy, hầu hết người dân Pháp đều không muốn ông Strauss-Kahn trở lại chính trường nước này.

PARIS (AP) - Một nhà văn nữ trẻ tuổi người Pháp hôm Thứ Ba nộp đơn kiện ông Dominique Strauss-Kahn, tố ông đã từng mưu toan hiếp dâm cô, trong đơn cô nói ông Kahn xé toạc áo quần cô trong khi họ vật lộn tại nhà riêng của ông.

Ðơn kiện của cô Tristane Banon được nộp, vào lúc dư luận Pháp đang bị phân hóa sau vụ ông cựu chủ tịch Quỹ Tiền Tệ Quốc Tế, IMF, bị tố tội cưỡng hiếp cô hầu phòng một khách sạn ở New York nhưng cuối cùng cáo trạng của phía công tố không đứng vững sau khi độ khả tín về lời khai của nguyên đơn bị nghi ngờ.
Cô Banon kể lại với tạp chí tin tức L'Express, ông ấy chụp tay, rồi nắm lấy vai cô. Cô bảo ông ta buông tay ra và đó là lúc họ bắt đầu giằng co. Ổng kéo cô về phía ông, cả hai cùng té nhào và họ vật lộn trên sàn suốt cả mấy phút.
Banon nói cô bắt đầu dùng bốt để đạp rồi sau cùng cô thoát được. Cô chạy xuống lầu và vào ngồi trong xe gọi cho mẹ biết. Cô Banon nói bấy giờ cô run quá không lái xe được.
Luật Sư David Koubbi cho biết, mẹ cô, bà Anne Mansouret, cố vấn cấp vùng trong đảng Xã Hội của ông Strauss-Kahn, khuyên cô chớ nên kiện. Nhưng nay bà Mansouret nói bà lấy làm tiếc đã không giục con gái mình nộp đơn kiện, nhưng vẫn nghĩ rằng kiện một người có thế lực lớn sẽ ảnh hưởng đến tương lai nghề nghiệp.
Những người ủng hộ ông Strauss-Kahn hôm Thứ Ba liền vội lên đài để hạch tội cô Banon, họ đặt câu hỏi về thời gian tính của vụ kiện, mà theo cô này, xảy ra hồi năm 2003, khi cô tìm cách phỏng vấn ông về một dự tính ra sách. Cô Banon có nhắc đến vụ này trong một show truyền hình năm 2007, trong đó tên ông Kahn bị xóa đi.
Hôm Thứ Hai, luật sư ông Kahn gọi lời cáo buộc của cô Banon là “tưởng tượng,” và thêm rằng họ sẽ nộp đơn kiện ngược cô này về tội vu khống.
Nếu vụ kiện của cô Banon được đưa ra sơ thẩm, một cuộc điều tra kéo dài sẽ diễn ra, đôi khi đến vài năm để xác định xem có đáng để đưa ra xử không.
Một tiến trình tương tự cũng được áp dụng nếu có đơn kiện ngược lại, tố cô Banon tội vu khống.
Tội vu khống áp dụng đối với những ai mà phía công tố ở Pháp cho là tự ý man khai để kiện giới chức công quyền. Trường hợp cô Banon, cuộc điều tra sẽ bắt đầu nếu lời khai bị hiếp dâm của cô nhận thấy có giả dối. Người mắc tội vu cáo có thể bị tù đến 5 năm và 45,000 Euro ($65,000) tiền phạt.
Công tố viện ở Pháp có thể quyết định không tiếp tục vụ kiện ông Kahn, nếu họ nhận thấy hành động cưỡng bức tình dục chưa đủ để cấu thành mưu toan hiếp dâm. Thời gian giới hạn cho vụ kiện về tấn công tình dục ở Pháp là ba năm, trong khi mưu toan hiếp dâm có thể lên đến 10 năm. (TP)

05/07 Did Dominique Strauss-Kahn Try To Rape Tristane Banon?


Seven ways to check his story and hers against the evidence.

While the New York sexual assault case against Dominique Strauss-Kahn unravels, another case against him has surfaced in France. Tristane Banon, a friend of Strauss-Kahn's daughter and a goddaughter of his second wife, is filing a complaint against him for attempted rape.
Strauss-Kahn wants the collapse of the New York case to discredit Banon. In a statement from his lawyers, he "notes that this complaint comes quite conveniently right at the moment when there is no longer the slightest doubt about the false nature of the accusations against him in the United States."
But that isn't true. The falsity of the accusations in New Yorkremains in doubt. And Banon's case is a separate question. The New York accuser has failed tests of corroboration. Banon is entitled to the same tests, with the possibility of a different result. Can her allegations be confirmed? Let's investigate them.
Banon says that in February 2003, when she was 23, she interviewed Strauss-Kahn for a book. Afterward, he phoned her and asked her to meet him at a Paris address for a follow-up interview. The address turned out to be an apartment. There, he touched her and became increasingly physical. She resisted. On a TV show four years ago, she said, according to a Telegraphtranslation, that the encounter "ended very, very violently because I told him clearly. ... We didn't merely slap each other. … I gave kicks, and he undid my bra, he tried to undo my jeans." Agence France Presse translates her account differently: "I told him clearly 'No, No!'—and we finished up fighting on the floor. There wasn't just a couple of blows. I kicked him, and he tried to unclip my bra, to open my jeans." In an interview just published in L'Express, Banon describes
his fingers in my mouth, his hands in my pants. … [He] grabbed my hand and arm, I asked him to let me go. … He pulled me toward him, we came down and we fought on the ground for several minutes. ... He was violent. When I realized he really wanted to rape me, I started to give him a kick with my boots, I was terrified and I told him: "You're not going to rape me?" And then I managed to free myself, I ran downstairs …
Banon says she tried to stop Strauss-Kahn by reminding him that she was close to his daughter's age. She says he replied: "What does Camille have to do with it?"

In his authorized biography, published four months ago, Strauss-Kahnsays of Banon's allegations, "The scene she describes is imaginary. Do you see me throwing a woman on the floor and being violent, as she claims?" He saysBanon "contacted me through my daughter Camille … The interview took place normally, and at its end, I had a phone call to Michel Field to grant him an interview in his turn."
It sounds as though Strauss-Kahn is describing the initial interview and denying that he phoned Banon for a follow-up session at the apartment. Such a denial would make it easier to check his account and hers against external records. Here are a few of them:
1. The apartment. Banon says it was located "between Montparnasse and the National Assembly, in a street near the Boulevard des Invalides, and he told me it was the apartment of a friend." She says it "was almost empty, white, exposed beams, a coffee machine, a round table … an empty library, and, basically, a room with a bed." If Strauss-Kahn denies that they were together in such an apartment, it should be possible to find out whether it existed, and, if so, whether one of his friends owned it. If it did exist, Banon's description can be checked for accuracy. If she's accurate, Strauss-Kahn would need to explain how she knows what it looked like inside. Alternatively, if he admits to meeting her there, other French journalists can be quizzed to find out whether he invited them to the same place, or whether he reserved it for pretty young women.
2. The tape recorder. In her 2007 account, Banon said, "I put down the tape recorder immediately to record. He wanted me to hold his hand while he answered, because he told me: 'I won't be able to if you don't hold my hand.' And after that, from my hand, he went to my arm, and then a bit higher." In her latest account, she says that after Strauss-Kahn held her hand and she told him she wanted to leave, "He stopped the dictaphone, grabbed my hand and arm," and the struggle began. If these accounts are true, then she had a tape recording of him asking to hold her hand, which would falsify his depiction of their interview as normal. Where is the recording?
3. The call to Mom. Banon says, "I managed to free myself, I ran downstairs, I found myself in my car, I called my mother because I could not even drive, I was shaking so much." Does Banon's mother recall this conversation?
4. The parking ticket. Banon says she got a "PV" (French parking ticket) at the meter where she parked for the interview. Where's the ticket? The address would help nail down the apartment's location, and the time could be checked against Strauss-Kahn's schedule. It could also be compared with his phone records to see whether he called Michel Field afterward.
5. The text messages. Banon says that after she left the meeting, Strauss-Kahn "sent me a text message straight away saying: 'So, are you afraid of me?' in a provocative tone. … After that, he was continually sending me text messages." Do her phone records show these text messages? If so, how could Strauss-Kahn explain them?
6. The apology. Strauss-Kahn says that in the last four years, he and Banon's mother, a fellow Socialist politician, have run into each other two or three times at party events. According to Strauss-Kahn's biographer, "They talked about the accusations against him by the young writer. And have, according to him, left on good terms, as if this case was a misunderstanding." But Banon's mother says that in one conversation, Strauss-Kahn told her, "Je sais pas ce qui m'a pris, j'ai pété un plomb." Roughly translated, that means: "I don't know what came over me. I lost my mind." This report from Banon's mother doesn't depend on anything her daughter said. It's a direct quote from Strauss-Kahn. How does he explain it? Is the mother delusional as well as the daughter?
7. Francois Hollande. Banon says Francois Hollande, who was then the head of the Socialist Party, knew about her victimization, called her about it, and recommended that she pursue a complaint. But Hollande says he has "no knowledge of the facts, real or imagined" and was "never aware" of such grave allegations. Banon now says of Hollande, "He lies." Does he? Or does his failure to confirm her recollection undermine her credibility?
Either way, Banon deserves to have her story tested against the evidence. Maybe it will discredit her. Maybe it will discredit Strauss-Kahn. What's important is to focus oncorroboration and falsification, not on who wins or loses. Forget the case in New York. Set aside your prejudices about rich men and rape accusers. Banon, like Strauss-Kahn, is entitled to a fair hearing and thorough scrutiny. Don't take her word for what happened. Don't take his, either.

04/07 Tristane Banon veut à nouveau porter plainte contre DSK

Les rebondissements n'en finissent plus autour de Dominique Strauss-Kahn. Quelques heures à peine après que l'avocat de Tristane Banon a fait savoir que celle-ci allait porter plainte pour tentative de viol, les avocats français de l'ancien directeur du FMI ont contre-attaqué lundi 4 juillet en annonçant le dépôt d'une plainte pour dénonciation calomnieuse.
M. Strauss-Kahn "a pris connaissance de l'intention de Mme Tristane Banon de déposer plainte à son encontre". Or les faits qu'elle évoque sont "imaginaires", affirme le communiqué des avocats de DSK. Par conséquent, Me Henri Leclerc et son associée, Me Frédérique Baulieu"ont été chargés de rédiger une plainte en dénonciation calomnieuse contre Mme Banon".
"INCITÉE" À PORTER PLAINTE
La journaliste et écrivaine, qui avait déclaré en juin ne pas vouloir s'associer à la procédure américaine à l'encontre de DSK et se dit victime d'une agression à caractère sexuel de la part de DSK, a finalement décidé de déposer plainte mardi,a indiqué lundi son avocat, David Koubbi dans un entretien publié sur le site Internet de L'Express.
La nouvelle a été accueillie avec scepticisme à gauche. Le député socialiste Jean-Christophe Cambadélis, proche de DSK, a estimé, lundi sur Europe 1, que Tristane Banon avait sans doute été "fortement incitée" à porter plainte, soulignant qu'il lui avait fallu "huit ans de réflexion" pour se décider. "Je suppose que ce n'est pas en se regardant dans la glace le matin, qu'elle s'est dit : 'Mais tiens, au fait, aujourd'hui il faut que je porte plainte'", a ajouté le député de Paris. Selon lui, "il y a eu une petite discussion, ne serait-ce qu'avec son avocat et un certain nombre de gens qui sont dans son entourage".
En 2002, la mère de Tristan Banon, une élue socialiste, l'avait dissuadée de porter plainte. Depuis, Tristane Banon envisageait une action en justice.
UNE DÉCISION PRISE DÈS LA MI-JUIN
"Avec ma cliente, nous avions pris notre décision avant ce rebondissement du 1erjuillet, à savoir dès la mi-juin", a précisé David Koubbi en allusion aux doutes apparus quant à la véracité des accusations de viol contre DSK portées par une femme de chambre de l'hôtel Sofitel de ManhattanL'Express a effectivement précisé lundi que cet entretien s'était fait en deux fois : la première rencontre avec la jeune femme s'est tenue le 29 juin, c'est-à-dire avant l'annonce du possible effondrement des accusations aux Etats-Unis.
La justice américaine a libéré vendredi sans caution Dominique Strauss-Kahn et lui a rendu l'argent versé en garantie en raison de doutes sur la crédibilité de la femme de chambre qui l'accuse de tentative de viol. Mais pour l'heure, aucune des accusations retenues contre l'ancien favori des sondages pour la présidentielle de 2012 n'est abandonnée, a précisé le procureur général de New York. De l'autre côté de l'Atlantique, l'avocat de la femme de chambre du Sofitel a déclaré soutenir Tristane Banon.
"À LA SOLDE DE PERSONNE"
Après avoir annoncé le 16 mai que sa cliente envisageait de porter plainte contre Dominique Strauss-Kahn, Me Koubbi avait indiqué quatre jours plus tard que la décision sur ce point était "réservée à plus tard", renonçant de facto à le poursuivre. "Nous ne témoignerons pas dans le cadre du procès américain", avait-il ajouté. "En aucun cas, ni Tristane Banon ni moi-même ne souhaitons être instrumentalisés par la justice américaine ou prêter quelque concours que ce soit afin que ces deux dossiers soient liés d'une manière ou d'une autre", avait alors déclaré Me Koubbi.
Des propos qu'il a confirmés lundi : "Je n'ai été contacté par personne à droite, je ne suis à la solde de personne. (...) Je n'ai pas agi en fonction du contexte", assure Me Koubbi. Pour porter plainte aujourd'hui pour des faits remontant à février 2003, selon Me Koubbi, il incombe néanmoins à Tristane Banon de prouver qu'elle a été effectivement victime d'une tentative de viol, un crime prescrit au bout de dix ans et passible de quinze ans de réclusion.
Aucune poursuite ne peut plus désormais être engagée pour un autre type d'agression sexuelle, constituant un délit passible de cinq ans de prison, mais prescrit au bout de trois ans.
NE PAS ÊTRE "LA FILLE QUI A EU UN PROBLÈME AVEC UN HOMME POLITIQUE"
Tristane Banon avait raconté en février 2007 à la télévision avoir été agressée sexuellement cinq ans plus tôt par M. Strauss-Kahn, dont le nom avait toutefois été masqué lors de la diffusion de l'émission. Elle avait expliqué avoir dû se débattre pour se défaire d'un homme qui lui "a dégrafé (son) soutien-gorge, a essayé d'ouvrir (son) jean". A l'époque, Tristane Banon avait décidé de ne pas déposer plainte pour ne "pas être, jusqu'à la fin de (ses) jours, la fille qui a eu un problème avec un homme politique".
Dans un entretien mis en ligne lundi sur le site Internet de L'Express, Tristane Banon explique ne plus supporter "d'entendre dire qu'(elle) est une menteuse du fait qu'(elle) ne porte pas plainte""Aujourd'hui, de voir Strauss-Kahn libéré puis aussitôt dîner dans un restaurant de luxe entre amis, ça me rend malade", ajoute-t-elle.
